1. Acceptance of These Terms
By using northernclimatesudbury.com, requesting a quote, or engaging Northern Climate ("we", "us", or "the Company") for services, you agree to these Terms of Service. If you do not agree, please do not use our website or services.
2. Description of Services
Northern Climate provides residential and light-commercial heating, cooling, fireplace, and water heater services in Greater Sudbury and surrounding communities. Specific scope is defined in the written quote or work order for each project.
3. Quotes & Pricing
Written quotes are based on the information available at the time of issue and a visual site assessment where applicable. Quotes are valid for 30 days unless otherwise stated. Final pricing may change if hidden conditions are discovered on site (e.g., concealed damage, code compliance work, or required permits). We will notify you and obtain approval before performing work that exceeds the quoted amount. Prices do not include applicable taxes unless specifically stated.
4. Appointments & Cancellations
We ask for at least 24 hours' notice for non-emergency cancellations or reschedules so we can offer the slot to another customer. Emergency calls (no heat in winter, gas leaks, flooding, etc.) are treated as priority and are not subject to this notice. Missed appointments may incur a service-call fee.
5. Payment Terms
Unless financing has been pre-arranged, payment is due upon completion of the work. We accept e-transfer, credit card, debit, and cheque. NSF cheques are subject to a $50 service fee plus any bank charges. Past-due accounts may be subject to interest at 1.5% per month (19.56% per annum) and to collection action.
6. Warranties
Equipment carries the manufacturer's warranty (e.g., Bryant, Regency, Enviro, Navien, Rinnai, Bradford White, Continental). Registration of warranty may be required and is generally handled by us at the time of installation. Northern Climate offers a one-year workmanship warranty on installation labour, beginning on the date of installation. The workmanship warranty does not cover damage caused by misuse, lack of maintenance, alterations performed by third parties, or events outside our control.
7. Customer Responsibilities
You agree to provide safe access to the work area, accurate information about your equipment, and any required permissions from a landlord, condominium board, or co-owner. You are responsible for moving valuables and pets out of the work area, and for accurate disclosure of any known hazards (asbestos, mold, knob-and-tube wiring, etc.) before work begins.
8. Limitation of Liability
To the maximum extent permitted by law, Northern Climate's total liability arising out of or relating to the services performed shall not exceed the amount you paid for those services. We are not liable for indirect, incidental, consequential, or punitive damages, including loss of use, lost profits, or property damage caused by pre-existing conditions outside the scope of work.
9. Force Majeure
We are not responsible for delays or failures to perform caused by events outside our reasonable control, including severe weather, supply chain disruptions, manufacturer back-orders, utility outages, labour disputes, government orders, or pandemic-related restrictions.
10. Intellectual Property
All content on this website — text, photos, logos, design — is the property of Northern Climate or its licensors and is protected by Canadian copyright and trademark law. You may not copy, redistribute, or use the content for commercial purposes without written permission.
11. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. Any dispute will be resolved in the courts of Ontario.
12. Changes to These Terms
We may update these Terms periodically. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of our website or services after changes are posted indicates acceptance of the revised Terms.
